- hereinafter referred to as TOURNANTI –

provides to the

CUSTOMER

within the scope of the commissioned services, subject to these General Terms and Conditions.

General

The following General Terms and Conditions (GTC) apply to our services offered on the TOURNANTI.de / .com website.

The TOURNANTI.de / .com websites are operated by BuBa Verwaltung UG (limited liability).

Service Contract

All tour planning services offered by TOURNANTI are considered services within the meaning of the German Civil Code (BGB). The application of the statutory provisions for travel or package travel contracts is therefore excluded.

By submitting a non-binding inquiry, the customer requests a customized offer from TOURNANTI. TOURNANTI's offer is subject to a binding period of 15 days unless a different binding period is explicitly stated in the individual offer. The contract for the service to be provided is only concluded upon mutual acceptance and confirmation by TOURNANTI.

The scope of services provided by TOURNANTI may, under certain circumstances, also include the recommendation of third-party services (ferries, hotel stays, events, exhibition visits, other sightseeing, etc.). TOURNANTI's service merely includes the recommendation of such third-party services in the context of tour planning, not the third-party service itself.

All services not expressly listed as included in the offer are not included in the service offer.

Verbal agreements only change the commissioned service offer with written confirmation.

Services, Customer's Obligation to Cooperate

The service description of the individual offer is the sole determining factor for the service to be provided by TOURNANTI. TOURNANTI undertakes to provide the commissioned services with due care.

The service is provided based on the information provided by the customer. The information provided by the customer, including their self-assessment of their driving ability, driving experience, and the appropriate characteristics of the desired tour, combined with the customer's feedback on planning suggestions, is always based on the principle of personal responsibility. TOURNANTI does not verify this information.

Remuneration and Payment

The individual offer includes the fee for the service and the payment terms.

The fee is generally paid as a down payment of 50% of the total fee upon placing the order and a final payment of 50% before the final and detailed tour plan is sent. Different percentages may be specified in the offer. Depending on the scope of the agreed service, additional interim payments may apply.

If TOURNANTI recommends third-party services, TOURNANTI assumes no responsibility for their implementation.

Withdrawal by the Customer

The customer may stop the provision of the agreed service and terminate the contract at any time. In such a case, the customer is not entitled to a refund of any advance payments or interim payments already made. Cancellation fees may also apply, if specified in the offer.

By terminating the contract, the customer waives the right to hand over the planning results, unless these results have already been handed over at the time of termination.

Rights of Use

Only upon full payment of the agreed fee is the customer granted the irrevocable, non-exclusive, non-transferable, temporally and geographically unlimited right to use the planning results for the intended purpose.

All other rights of use and ownership remain with TOURNANTI.

Disclosure or publication of the planning results without the prior written consent of TOURNANTI is prohibited.

TOURNANTI warrants that the services provided under the contract are free from third-party intellectual property rights and that, to its knowledge, no other rights exist that restrict or exclude this right of use. 

Liability

Liability for damages resulting from the planning service provided is limited to intent and gross negligence within the framework of the statutory provisions pursuant to Section 611 of the German Civil Code (BGB), unless there is a breach of essential contractual obligations.

The scope of liability is in any case limited to three times the agreed total fee.

Any further claim for damages against TOURNANTI is excluded.

The principle of the customer's own responsibility applies. The use of the planning results provided by TOURNANTI and the implementation of the information contained therein for the implementation of a trip is expressly at the customer's own risk. TOURNANTI will not accept any liability for any accidents or damages of any kind arising from the use and application of the planning results (e.g., due to missing safety instructions) under any legal grounds.

Claims for damages against TOURNANTI for material or immaterial damages resulting from the use or non-use of the information, or from the use of incorrect and/or incomplete information, are fundamentally excluded.

When using any planning results during a trip, the customer assumes personal responsibility and continuously observes the following fundamental aspects:

  • Personal driving ability,

  • Fitness to drive,

  • Any legal regulations of the respective country,

  • Weather,

  • Physical condition,

  • Traffic,

  • Unforeseen events such as local forest fires, road closures, severe weather,

  • Wearing appropriate protective clothing for motorcycle riding (helmet, boots, gloves, abrasion-resistant jacket and trousers),

  • Passport, visa, customs, health, and other regulations of the countries visited,

  • Possession and carrying of a valid driver's license,

  • Registration of the motorcycle for public road use and carrying of the necessary vehicle and insurance documents,

  • Safe driving condition of the motorcycle, with particular attention to wear parts such as Tires,

  • Taking out insurance, e.g., trip cancellation, accident, international health, and medical repatriation insurance, vehicle protection insurance for the motorcycle,

  • Observance of the traffic regulations of the German Road Traffic Act (StVO) and the German Road Traffic Licensing Regulations (StVZO) or the applicable rules for driving a motorcycle in the country being traveled to,

  • Compliance with the applicable regulations regarding liability and vehicle insurance.

This list is intended only to clarify the principle of personal responsibility and does not claim to be complete.

Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies exclusively. The place of jurisdiction is Munich.

Images and Film Material

Images and film material provided by the customer to TOURNANTI are released for use for informational and advertising purposes upon handover. The customer expressly consents to the use and publication online, in particular on TOURNANTI.de / .com and on networks such as LinkedIn, etc.

Changes and Extensions to the Terms and Conditions

TOURNANTI reserves the right to change the Terms and Conditions / Terms of Use at any time at its sole discretion.

The Terms and Conditions attached to each order apply to each order. The customer accepts these Terms and Conditions by placing the order.

Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
